Videography Is Not A Crime – The Story of Carlos Miller
Here’s an interesting video story out of Miami-Dade, where a staunch photographer’s rights advocate named Carlos Miller tangled with the police in early February during the ouster of the Occupy Miami movement. Most relevant to videographers is that the police allegedly deleted the video from Miller’s camera of the somewhat benign events that ultimately led to his incarceration for resisting arrest. After the fact, Miller was able to reconstitute the deleted file by using Stellar Phoenix and PhotoRec recovery software. Regardless of the politics, it’s important as videographers and photographers to know your rights when confronted by the police. You can find ACLU’s breakdown of photographer’s rights here and there is a printable PDF guide here. Read Miller’s full account of the ordeal here.
